These Terms of Service (“Terms”) govern your use of lakewoodwebsites.com and the products operated by Lakewood Websites LLC (“Lakewood Websites,” “we,” “us,” or “our”), including the brands Abracasite (abracasite.com) and Mail350 (mail350.com), each a d/b/a of Lakewood Websites LLC (collectively, the “Service”).

1. Acceptance of Terms

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. Service Description

Lakewood Websites LLC provides web hosting, AI-assisted website creation, custom email hosting, domain management, and related communications services for small businesses and individuals through its operated brands.

3. Account & Eligibility

You must be at least 18 years old to create an account.
You are responsible for the confidentiality of your account credentials and all activity under your account.
You must provide accurate, current, and complete information.

4. Subscription & Billing

Paid plans are billed on a recurring basis (monthly or annually as selected).
You may cancel your subscription at any time from your dashboard.
Upon cancellation, your subscription remains active until the end of the current billing period.
No refunds are provided for partial billing periods.
Prices are subject to change with 30 days notice.
Payments are processed securely through Stripe. We do not store full credit card details on our servers.

5. Custom Domains & Subdomains

Free subdomains on our brand domains are provided with applicable plans and remain the property of Lakewood Websites LLC.
Custom domain registration is handled through third-party registrars and is subject to their terms.
You are responsible for renewing any custom domains you bring or register through us.

6. Acceptable Use

You agree not to use the Service to:

Violate any law, regulation, or third-party right.
Send spam, phishing, or unsolicited bulk communications.
Host malware, illegal content, or content that infringes intellectual property.
Attempt to gain unauthorized access to other accounts or the Service infrastructure.
Interfere with or disrupt the Service for other users.

We may suspend or terminate accounts that violate this policy.

7. AI-Generated Content

Some Service features generate content using artificial intelligence.
AI-generated content may require review and editing before use.
You are responsible for reviewing all generated content before publishing it.

8. SMS / Text Message Program Terms

These SMS Terms govern your use of the Lakewood Websites text messaging program (the “SMS Program”), operated under Lakewood Websites LLC and its brands. By providing your mobile number and opting in (for example, by checking the SMS consent box on our contact form at lakewoodwebsites.com/contact or abracasite.com/contact), you agree to receive text messages from us.

a) Program Description

The SMS Program sends recurring informational and transactional text messages, including but not limited to:

Account, billing, and security alerts
Password reset and two-factor authentication codes
Order, shipping, and delivery notifications
Support ticket updates and customer service replies
Service announcements and important updates

b) Message Frequency

Message frequency varies based on your account activity and events.

c) Message and Data Rates

Message and data rates may apply. Check with your wireless carrier for details on your plan. Lakewood Websites does not charge a separate fee for these messages.

d) Opt-In

You opt in to the SMS Program by:

Checking the “Yes, send me text messages” box on our contact or signup forms; or
Texting a keyword (such as JOIN) to one of our published numbers; or
Confirming an opt-in request you receive by text.

By opting in, you confirm you are the subscriber of, or have authority to provide consent for, the mobile number you submit.

e) Opt-Out

You can cancel the SMS Program at any time. Text STOP, END, CANCEL, UNSUBSCRIBE, or QUIT to the short code or long code from which you received messages. After you send the STOP message, we will send you a single message confirming you have been unsubscribed. After this, you will no longer receive SMS messages from us. To re-join, sign up again as you did the first time.

f) Help

Text HELP at any time and we will respond with instructions on how to use the Service and how to unsubscribe. You may also contact us at [email protected] for assistance.

g) Supported Carriers

The SMS Program is available on most major U.S. carriers, including AT&T, T-Mobile, Verizon Wireless, Sprint, Boost, U.S. Cellular, MetroPCS, and others. Carriers are not liable for delayed or undelivered messages.

h) Eligibility

You must be a resident of the United States and at least 18 years old to participate in the SMS Program.

i) Consent Not Required

Your consent to receive SMS messages is not a condition of any purchase. You may decline SMS and still use the Service.

j) Privacy

Information you provide is governed by our Privacy Policy. We do not sell, rent, or share your mobile number or SMS opt-in data with third parties or affiliates for their marketing or promotional purposes.

k) Changes

We may change or discontinue the SMS Program, including phone numbers, short codes, or message content, at any time without notice. We will update these Terms to reflect material changes.

9. Intellectual Property

You retain ownership of content you upload or create.
The Lakewood Websites platform, branding, and underlying technology remain our intellectual property.
You grant us a limited license to host, display, and distribute your content as necessary to operate the Service.

10. Limitation of Liability

The Service is provided “as is” without warranties of any kind.
We are not liable for any indirect, incidental, or consequential damages.
Our total liability shall not exceed the amount you paid in the 12 months preceding the claim.
We do not guarantee uninterrupted service or that the Service will be error-free.

11. Indemnification

You agree to indemnify and hold Lakewood Websites LLC harmless from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

12. Modifications

We may modify these Terms at any time.
Continued use of the Service after changes constitutes acceptance of the new Terms.
Material changes will be communicated by email or in-app notification.

13. Termination

Either party may terminate the agreement at any time.
Upon termination, your account and content may be removed after the current billing period ends.
You may export your content before termination.

14. Governing Law

These Terms are governed by the laws of the State of New Jersey, United States, without regard to conflict-of-laws principles. Any disputes shall be resolved in the state or federal courts located in Ocean County, New Jersey, or by binding arbitration where required by law.
